For nearly twenty years, the attorneys of Jack Martin & Associates have been assisting clients involved in the manufacture, distribution, marketing and sale of alcoholic beverages in Texas in complying with the laws and regulations governing these activities.  We offer the following primary services, but stand ready to assist you with any issue affected by the Texas regulatory scheme:

  • Acquire original and renewal permits and licenses for clients in all levels of the alcoholic beverage industry in Texas
  • Design and assist in implementing operational structures to streamline reporting required under the Texas Alcoholic Beverage Code and the TABC’s rules
  • Design and assist in implementing compliant organizational and operational structures for foreign members of the alcoholic beverage industry entering the Texas market
  • Organize and obtain permits for private clubs authorized to serve alcoholic beverages in areas of Texas where the sale of alcoholic beverages for on-premises consumption is prohibited
  • Implement the transition from private club to retail sales operations of restaurants and other retailers located in formerly “dry” areas where the retail sale of alcoholic beverages has been authorized by local option election
  • Advise clients on petitioning for a local option election to change the wet/dry status of an area
  • Design permitting structures for stadiums, convention centers and other qualified facilities to minimize tax liability from the sale of alcoholic beverages
  • Assist in the transition of alcoholic beverage operations in the sale of businesses, either through proper notification to the TABC and TTB or through the implementation of interim operations pending the acquisition of new permits, as required by the structure of the sale
  • Assist clients in compliance with TABC reporting requirements related to changes in ownership and/or management personnel
  • Represent clients in audits conducted by the TABC
  • Advise clients in implementing marketing strategies compliant with the requirements of the Texas Alcoholic Beverage Code and the TABC’s rules, including “tied house” compliance
  • Design and assist in implementing seller/server training programs to minimize “dram shop” liability
  • Advise clients seeking changes in the Texas Alcoholic Beverage Code or the rules of the TABC
  • Advise lenders in obtaining effective liens on alcoholic beverage inventory pledged as collateral
  • Defend clients against alleged violations of the Texas Alcoholic Beverage Code or the TABC’s rules
  • Conduct in house seminars for clients to insure that pertinent personnel have a broad based, practical understanding of how to comply with the Texas Alcoholic Beverage Code and the TABC’s rules and the importance of compliance
  • Advise other law firms in alcoholic beverage licensing and compliance issues encountered by their clients
